Sales Agreement

SUBJECT
This Sales Agreement is concluded between Alppaşa Seyahat Turizm Tekstil İnş. San. Tic. A.Ş. (hereinafter referred to as the "AGENCY") and the person purchasing products/services through the website www.topazetravel.com (hereinafter referred to as the "BUYER"). The agreement regulates the rights and obligations of the parties in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

1. General Terms of Reservation

1.1. The BUYER agrees to cover all extra expenses not included in the purchased service (e.g., food and beverage, personal expenses, spa services) and any goods or services outside the defined scope of the purchased service.
1.2. Accommodation fees include the accommodation tax in accordance with Article 34 of Law No. 6802.
1.3. In case of technical or material errors in prices, features, or descriptions, the AGENCY reserves the right to cancel the service and refund the collected amounts under Article 30 of the Turkish Code of Obligations.
1.4. All details and terms regarding the services are specified in the reservation details on the TopazeTravel.com website. The BUYER is obliged to carefully review this information before making a reservation.

2. Payment Information

2.1. The BUYER is required to pay the full amount of the service at the time of reservation. The BUYER is responsible for making payments on the specified dates for campaigns or special payment options.
2.2. In the event of unlawful or unauthorized use of the credit card, resulting in non-payment to the AGENCY by the bank or financial institution, the BUYER agrees to pay the outstanding amount with applicable legal interest.

3. Right of Withdrawal

3.1. Pursuant to Article 15 of the Regulation on Distance Contracts, there is no right of withdrawal for the services covered by this agreement.
3.2. However, cancellation and refund requests are subject to the cancellation policies outlined below.

4. Cancellation and Refund Policies

4.1. AGENCY's Right to Cancel:

The AGENCY reserves the right to cancel the reservation or change service providers up to 7 days before the service starts. In such cases, the BUYER is entitled to a full refund of the amounts paid.

4.2. BUYER's Right to Cancel:

The BUYER is responsible for reviewing the cancellation policies and price type specified by the relevant service provider before making a reservation. Cancellation conditions for each reservation are determined by the service provider and are primarily governed by those terms.

For informational purposes, and unless otherwise specified by the service provider, the following general rules may apply:

  • Cancellations made 30 days before the reservation start date: Full refund.
  • Cancellations made 15-30 days before the reservation start date: 50% refund.
  • Cancellations made 14 days or less before the reservation start date: No refund.

The BUYER acknowledges that different rules may apply depending on the price type selected and the specific cancellation policies set by the service provider. In cancellation requests, the service provider's policies shall prevail.

4.3. Non-Participation in the Service:

If the BUYER fails to participate in the service by the designated check-in time, the AGENCY reserves the right to cancel the reservation after 24 hours, and no refund will be provided.

4.4. Cancellation by the AGENCY:

If the AGENCY cancels the service due to the unavailability of the service provider, the BUYER will be offered the following options:

  • A full refund of the amount paid within 14 days.
  • An alternative service of the same or lower cost.
  • A higher-value service, provided that the BUYER covers the difference in cost.

5. Transfer Services

5.1. Cancellation and modification conditions for transfer services may vary depending on the region and period. The BUYER can contact the AGENCY’s call center for detailed information on these conditions.

6. Reservation Cancellation and Refund Package

6.1. If the BUYER purchases the Reservation Cancellation and Refund Package, they are entitled to cancel the reservation without penalty up to 72 hours before the start date.
6.2. The cancellation and refund package fee is determined based on the accommodation cost and is non-refundable. This package only covers hotel stays; flights, transfers, and other services are excluded.

7. Evidence Clause

7.1. In disputes between the BUYER and the AGENCY, the AGENCY's digital records constitute conclusive evidence. The BUYER reserves the right to contest these records.

8. Liability and Force Majeure

8.1. AGENCY's Liability:

The AGENCY is responsible for fulfilling its obligations under this agreement. However, the AGENCY cannot be held liable for delays or cancellations caused by force majeure events.

8.2. Force Majeure:

Force majeure events include, but are not limited to:

  • Natural disasters (earthquakes, floods, fires, etc.).
  • Epidemics, pandemics, strikes, wars, terrorist activities.
  • Weather conditions and other unforeseen circumstances.

In such cases, the AGENCY reserves the right to cancel or postpone the service.

9. Personal Data Protection

9.1. The BUYER's personal data is processed in compliance with the Personal Data Protection Law No. 6698. For more details, the BUYER may review the Personal Data Protection and Privacy Policy on the TopazeTravel.com website.

10. Dispute Resolution

10.1. If the BUYER encounters any issues with the product or service, they may contact the AGENCY’s customer relations department.
10.2. Antalya Courts and Enforcement Offices are authorized to resolve disputes between the parties. The BUYER also retains the right to apply to Consumer Arbitration Committees for claims within the scope of consumer rights.

11. Validity

11.1. This agreement becomes effective once the BUYER electronically approves it.
11.2. The BUYER declares that they have fully read, understood, and accepted the terms of this agreement.
